Harmonisation of LVD and Ecodesign Non-compliance risk classification

In JAHARP2022-04, WP2 LVD and Ecodesign market surveillance authorities worked together to harmonise the classification of risk of non-compliance. The severity of the risk of non-compliance is important when making decisions  to take corrective measures and imposing fines.

Cases from previous LVD and Ecodesign joint actions on tumble dryers were used to create a template. This template can help with the different steps of the risk assessment. For LVD, the Safety Gate Risk Assessment Guidelines (RAG) are used. For Ecodesign and Energy Label, the non-compliance risk determination sheet from the ADCO is used. It is not the intention to have the template adopted by the ADCOs, MSAs are free to use the template or parts of it.

A comparison of the outcomes of the risk assessment and the follow-up discussions yielded interesting observations and difficulties the MSAs are facing.
